Unlike my first Italian real estate transaction six years earlier, where I received outstanding service from both the realtor and seller, after making an offer and placing a deposit on an apartment in Milano, both the seller and realtor failed to communicate regularly and often were completely unresponsive. In addition, the seller was two months behind on completing the apartment and could not provide a schedule to complete. I decided to look for an attorney experienced in Italian real estate transactions by non-residents and able to work with me in English. Fortunately, I found Alessandro Clemente.

Mr. Clemente immediately began to work on the transaction bringing the seller and their realtor together to bring focus on completing the apartment according to the seller’s commitments. Despite the seller’s commitment to engage, Mr. Clemente and I had to continue managing the details of getting it finished.

As the apartment approached completion two major anomalies in the construction surfaced. First, the air conditioning condensers were not installed in accordance with the manufacturer’s installation guidelines and clearances and building requirements. The method of installation voided the warranty and introduced the potential for a fire hazard. Second, when Mr. Clemente investigated the homeowners association documents and meeting records, he uncovered an issue with the heating system installed by the seller. Mr. Clemente met with the building administrator who explained that the seller failed to ensure the form of heating installed in the apartment would not negatively affect other apartments drawing from the building’s central system. If neither of these were addressed before closing, I would be liable for any damage to the building from both the cooling and heating systems and warranties for both voided due to these issues.

The seller repetitively attempted to dismiss these issues and I canceled the scheduled closing. Subsequently, Mr. Clemente successfully obtained commitments from the seller to warranty both systems and accept all liability for the consequences of the method of installation. Without Mr. Clemente’s attention to detail, persistence and creativity to negotiate an acceptable solution for these anomalies my purchase would be in jeopardy.

Should I sell or purchase real estate again in Italy, I will first retain Mr. Clemente and strongly recommend all non-Italian buyers do the same. Grazie mille Sig. Clemente!!
